1. ORDERING FROM WINE.COM.AU
1.1 When placing an order from wine.com.au you confirm that you are over the age of 18 years, and that all details relating to your order are true and correct. It is a legal requirement that the person placing the order is over the age of 18 years, and also that the person receiving the delivery is over the age of 18 years. You will be asked to supply your date of birth in order to finalise your purchase with wine.com.au. You confirm that any gifts you purchase via wine.com.au will be received by persons over the age of 18 years.
1.2 Orders placed via wine.com.au are subject to our Delivery Information as described in paragraph 5 below. Returns (refunds) for orders made via the website are available as described in paragraph 6 below.
1.3 All prices are in Australian dollars and are inclusive of GST.
1.4 All goods or services are provided in accordance with your rights under Australian Consumer Law. Nothing in these terms and conditions displaces your rights under the Australian Consumer Law.
1.5 From time to time, we may offer promotions and value-adds which will appear on our website. The terms and conditions of any promotion or value-add will appear on the website. You must read and agree to the terms and conditions of any promotion or value-add prior to making any order which includes a promotion or value-add.

2.1 Website software, all imagery, and content are provided as is, and are provided without any warranties of any kind. wine.com.au may make changes to website functionality, content, imagery, services etc at any time without notice.
2.2 Much of the content available on wine.com.au has been sourced from suppliers, and as such, wine.com.au make no warranties or claims as to the validity of content provided, availability of product, or accuracy of content and imagery, however, best efforts are made to ensure that content is as accurate as possible.
2.3 Vintages are subject to change.

3.1 The content, layout, design, and concept are belongs or is licensed to wine.com.au. Any use, reproduction, downloading etc of any part of wine.com.au other than as expressly permitted via wine.com.au's written consent is strictly prohibited.

4.1 wine.com.au may provide links to third party sites. The links do not indicate, expressly, or implied, any endorsement of content, imagery, products, services etc by wine.com.au. If you intend to follow those links, you do so at your own risk.
5.1 Delivery rates are calculated at the checkout.
5.2 All deliveries are processed by either wine.com.au drivers or third party couriers depending on the destination. Delivery vendors are selected at the discretion of wine.com.au.

5.4 Liquor licensing legislation prevents us from delivering alcohol to dry communities located in the below postcodes:

5.5 International Delivery. wine.com.au only deliver to addresses located in Australia as specified in our Delivery Terms & Conditions. Should you wish to have a purchase delivered to a location outside of Australia you will need to make arrangements with your own shipping agent. wine.com.au will not be responsible in any way for deliveries outside of Australia arranged by you.
5.6 wine.com.au ensures that all items delivered are in merchantable condition. Please contact wine.com.au immediately to advise of any breakage, or concerns with your delivery on LiveChat or call 1300 08WINE(083 463).
6.1 We offer returns (refunds) in line with your rights under Australian Consumer Law
'Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.'
6.2 In the event your order is delivered as faulty, damaged, or does not match the items ordered, we will gladly refund the price of your purchase, including delivery charges, with your proof of purchase, or provide an exchange if preferred. If this does occur, please contact us directly on 1300 08WINE(089 463) as soon as you identify the problem. Please allow up to 10 business days to process your refund or exchange. Where goods delivered are faulty, damaged, or do not match the items ordered by you, wine.com.au will arrange for pick-up of the items and cover all costs of return.
8.1 Payment options.
(a) For Approved Credit Accounts, all orders placed on the website by the certified account contacts can be processed on the Account Payment Terms. If the account is within its trading terms the goods will be shipped. Credit Accounts are approved at our discretion, subject to credit and reference checks and guarantees.
(b) For Non Account holders, all orders placed on the website must be paid in full before shipment of the goods. Where payment for an order is made by credit card, we do not store your credit card number on our servers, however it may be retained by our payment gateway provider in circumstances where this is required.
8.2 In cases where your payment for an order fails for any reason we do not warrant that stock will be held until an alternate payment method is available or the original payment is otherwise effected.

wine.com.au takes the Liquor Licensing Act and the Responsible Service of Alcohol very seriously and with the utmost importance. At all times, the Responsible Service of Alcohol is adhered to.
Under the Liquor Control Reform Act 1998 it is an offence: To supply alcohol to a person under the age of 18 years (Penalty exceeds $6,000) For a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $500)
